2. Acceptance
2.1
Access to the Site is subject to these Terms of Use, the Privacy Policy, and all applicable laws and regulations. Consequently, accessing the Site implies full and unreserved acceptance by the user (hereinafter the "User") of these Terms of Use and the Privacy Policy. The site is hosted by Odoo.
2.2
These Terms of Use and the Privacy Policy exclusively govern the relationship between the User and PiiVO regarding the use of the Site and the Service. They can be viewed on the Site at any time.
3. Limitation of liability
3.1
PiiVO will make every reasonable effort to ensure the Site is up to date and remains accessible to a normal number of Users. However, PiiVO does not guarantee that the Site's functions will be available without interruption or error, that defects will be corrected immediately, or that the server hosting the Site is free of viruses or other harmful components.
3.2
PiiVO cannot be held liable for any loss and/or damage of any kind resulting from the suspension, interruption, (technical) disruption, slowdown, restricted access, and/or termination of access to all or part of the Site, or from viruses or other harmful elements present on the Site.
3.3
If a User discovers an error, virus, or other harmful element on the Site, they are encouraged to notify PiiVO at contact@piivo.com so that the necessary measures can be taken. In any event, PiiVO advises Users to install firewalls, antivirus software, and other necessary protective tools on their computers to prevent potential damage.
3.4
PiiVO reserves the right to suspend or terminate all or part of the Site at any time, without providing justification and without prior notice.
4. Use of the site
4.1
Users agree to use the Site solely for its intended purpose and for no other reason.
4.2
Users are required to ensure that all information they provide is accurate and kept up to date.
4.3
The User agrees to use the Site in good faith and to comply with applicable legislation, and in particular to refrain from:
• send PiiVO content or communications that are false or misleading (and update such content, if necessary, to ensure it does not become false or misleading), obscene, racist or xenophobic, abusive, illegal, deceptive, invasive of another's privacy, offensive, harmful, violent, threatening or harassing, defamatory, infringing on intellectual property rights or any other rights, or that encourages or participates in any of the above;
• provide email addresses or other types of content to PiiVO without having obtained the prior consent of the individuals concerned;
• send PiiVO content that violates the rights of a third party or harms them in any way (intellectual property rights, privacy, trade secrets, etc.);
• send PiiVO content that links to illegal websites or contains inappropriate material;
• use the Site to send spam, unsolicited mail, pyramid schemes, or any similar or fraudulent process;
• circumvent technical protection measures for documents and multimedia elements;
• take any action that may disrupt the proper functioning of the Site or the Service, including the use of worms, viruses, logic bombs, or mass mailing;
• attempt to gain unauthorized access to any part of the Site or to equipment used for the operation of the Site;
• use a false name, a pseudonym, or impersonate another person or entity;
• use the Site for purposes other than those provided for in the Terms of Use.
4.4
PiiVO shall in no way be held liable for any failure by the User to comply with the Terms of Use, the Cookie Policy, the Charter, and/or applicable laws or regulations. The User shall indemnify and hold PiiVO harmless against any action, claim, or complaint by third parties (including public authorities) relating to their use of the Site.
4.5
The User uses the Site at their own risk. The Site, its components, and all related information, software, facilities, and services are provided on an "as is" and "as available" basis without warranties of any kind (either express or implied) to the fullest extent permitted by applicable law.
4.6
PiiVO disclaims all liability for any loss or damage (direct, indirect, material, or immaterial) resulting from the use of the Site and its components, or the inability to use the Site.
4.7
The User is also required to immediately inform PiiVO in writing if they become aware of any inappropriate behavior or use in connection with the Site by sending an email to the following address: contact@piivo.com.
5. Links to and from other sites
5.1
Hyperlinks to other websites may appear on the Site. Furthermore, some websites may include a link to the Site. These third-party sites are not controlled by PiiVO, which assumes no responsibility for their operation, content, or use. Unless expressly stated otherwise by PiiVO on the Site, the existence of such links does not imply any endorsement by PiiVO of these third-party sites or the use that may be made of them, nor any association or partnership with the operators of these sites.
6. Intellectual Property Rights
6.1
The Site and its components (trademarks, logos, graphics, photographs, animations, videos, music, text, etc.) are the property of PiiVO. They are protected by intellectual property rights (including copyright, design rights, trademark rights, etc.) and may not be reproduced, used, or distributed without the prior written authorization of PiiVO or, where applicable, the relevant rights holder. Failure to comply may constitute copyright, design, or trademark infringement, punishable by three months to three years of imprisonment and a fine of 80 to 80,000 euros, or either of these penalties alone.
6.2
Under these Terms of Use, PiiVO grants the User a non-exclusive, non-transferable license, for an indefinite period and revocable at any time without notice, to access, display, and download the content of the Site solely for display purposes. The User may also print a copy of the content displayed on the Site for personal use, provided that they do not alter the content of the Site in any way and retain all notices of authorship and origin. Reproduction is therefore authorized only for strictly private purposes within the meaning of Article XI.190 5° of the Code of Economic Law.
6.3
Any use of the Site and its components not covered by this article is strictly prohibited.
7. Disputes
7.1
To be valid, any claim by the User regarding the Site must be submitted in writing within eight (8) calendar days of becoming aware of the facts giving rise to the claim. Failure to contest the matter in accordance with the aforementioned rules constitutes the User's unconditional and unqualified acceptance of the facts giving rise to the claim and, de facto, the final waiver of any claim on these grounds.
8. Governing Law and Jurisdiction
8.1
The validity, interpretation, and/or execution of these Terms of Use are governed by Belgian law, to the fullest extent permitted by applicable private international law.
8.2
In the event of a dispute regarding the validity, interpretation, or execution of these Terms of Use, the courts of the judicial district of Brussels shall have exclusive jurisdiction, to the fullest extent permitted by applicable private international law.
8.3
Before initiating any judicial proceedings to resolve a dispute, the User and PiiVO agree to attempt an amicable resolution. To this end, they shall first contact one another before resorting, if necessary, to mediation, arbitration, or any other alternative dispute resolution method.
